Why We Are Here
TMV Compliance, Why It Matters
HARNCE was engaged following a compliance inspection at Bowbrook carried out by Total Environmental Compliance Ltd in December 2024. Following review of the asset register and discussion with site management, this revised proposal covers 138 serviceable TMV units, 126 hand wash basin, sink and toilet TMVs, 6 Arjo bath dedicated TMVs and 6 new TMV installations on unprotected mixer tap outlets identified during the HARNCE survey. Shower TMVs have been excluded from the programme at the request of site management.
What is a TMV and Why Does It Matter in a Care Home?
A Thermostatic Mixing Valve blends hot and cold water to deliver a safe, controlled outlet temperature, typically 39–43°C, preventing scalding at the point of use. In a care home where residents may have limited mobility, reduced sensation or cognitive impairment, a failed TMV presents a direct and serious risk of scalding injury. Annual testing and servicing is not optional, it is a legal requirement under multiple regulatory frameworks.
Regulatory Framework
The Legal Requirement
TMV servicing in a care home is governed by a layered framework of legislation, approved codes of practice and industry standards. Non-compliance exposes the operator to regulatory sanction, civil liability and CQC enforcement action.
HSE ACOP L8, Legionella
Approved Code of Practice requiring regular inspection, testing and maintenance of all water fittings including TMVs. Non-compliance is a criminal offence.
HSG274, Technical Guidance
HSE technical guidance supplementing L8. Part 2 covers hot and cold water systems and mandates annual TMV servicing including fail-safe testing to the TMV2/TMV3 scheme.
TMV3 Scheme, Healthcare
Sets the standard for TMVs in healthcare and care environments. Requires annual servicing, fail-safe testing, temperature verification and full documentation by a competent person.
HTM 04-01, Safe Water in Healthcare
NHS Health Technical Memorandum covering water safety in care premises. Sets requirements for TMV installation, maintenance and record keeping in care settings.
Health & Safety at Work Act 1974
Places a duty of care on those in control of premises to protect all persons. A scalding incident from a failed or unserviced TMV would likely constitute a breach of this duty.
Care Quality Commission (CQC)
CQC assessments cover fundamental standards of safety. Water safety compliance and TMV servicing records are an active area of CQC scrutiny in care home inspections.
Revised Scope, 138 Serviceable TMV Units
Following discussion with site management, this proposal covers HWB, sink, toilet and Arjo bath TMVs only. Shower TMVs (90 units) have been excluded at the request of Bowbrook and will be managed in-house. The 6 Arjo bath units are noted separately on all service documentation as dedicated bath TMVs distinct from the sink and HWB units in the same rooms.

Part One, Annual Programme
TMV Service, 138 Units
HARNCE offers two service levels for the annual TMV programme across all 138 units. All pricing shown is at standard pay-as-you-go rates. Contract pricing and discounts are shown in the Contract Options section.
Essential Service

The following works have been identified during the compliance inspection and the HARNCE site survey. They are separate from the annual service programme and will be quoted and agreed individually. Contract customers receive the applicable discount on all works listed below.

Note on Revised Defect Count
The original compliance inspection identified 8 TMV failures. Two of those failures, Asset 335618 (Room 12 Iris Shower, failed fail-safe) and Asset 335692 (Room 11 Waterlily Shower, faulty isolation valves), were shower units and have been removed from the remedial scope in line with Bowbrook's instruction to exclude shower TMVs from the programme. Six defects remain.

6 Mixer Taps, TMV Installation Recommended
During the HARNCE site survey, 6 mixer tap outlets were identified that currently have no TMV protection. It is recommended that TMV2/TMV3 approved thermostatic mixing valves are installed on each of these outlets. These 6 units are included in the 138-unit annual service count from year one of the contract. These works are subject to client authorisation and have not been included in the service contract pricing.

Terms & Conditions
What You Need to Know
The following terms apply to all works carried out by HARNCE Heating & Plumbing at Bowbrook Care Home under this proposal and any resulting contract.
Scope of Scheduled Works
The fixed contract price covers the annual scheduled TMV and plant room service only. Any additional works identified during a service visit will be quoted and agreed in writing before proceeding at the applicable contract discount rate. Assets not listed on the agreed service register at contract signing are outside scope. Any assets identified on site that are not on the register will be quoted as additional units before being serviced.
Asset Register
HARNCE's service programme is based on the asset register provided by the client or their appointed compliance contractor. HARNCE accepts no liability for assets not included on the register at the time of contract signing. HARNCE will carry out a full site verification survey prior to the first service visit to confirm register accuracy. The survey is completed on the first service visit day and is included within the first service price.
Shower TMV Exclusion, Client Acknowledgement Required
90 shower TMVs have been explicitly excluded from this contract at the written request of Bowbrook Care Home. HARNCE accepts no liability for the condition, performance or compliance status of any shower TMV or any other asset not listed in the agreed service register. By signing this contract, Bowbrook Care Home accepts full responsibility for the ongoing maintenance, testing and compliance of all excluded shower TMV assets.
TMV Replacement Allowance
Up to 2 or 5 TMV2/TMV3 approved replacement valves per year (depending on contract) are included where a valve cannot be restored during the annual service visit. This allowance covers individual valve failures identified during the scheduled annual service only. It does not cover failures resulting from system pressure issues, water quality problems, third party works or events outside HARNCE's control. Emergency reactive replacements outside the annual service visit are chargeable at the HARNCE standard hourly rate of £100 per hour, less the applicable contract discount (10% on 2 year contracts, 15% on 3 year contracts), plus materials at the prevailing trade price plus margin. Replacements beyond the annual allowance are charged at the prevailing trade price plus margin less the applicable contract discount.
Valve Specification
Where replacement is required, HARNCE will fit a TMV2/TMV3 approved valve of equal or greater specification to the existing unit. Where the original valve model has been discontinued or is unavailable, an approved equivalent will be fitted. HARNCE accepts no liability for price variations arising from product discontinuation or supply chain changes beyond its control.
Float Stock
HARNCE maintains a minimum of 2 TMV units (2 year contract) or 5 TMV units (3 year contract) as float stock throughout the duration of the contract. Installation TMVs for the 6 recommended mixer tap outlets are purchased separately as a direct job cost and do not draw from float stock. Used float stock units are replaced within 5 working days. Float stock remains the property of HARNCE until installed.
Access
Bowbrook is responsible for ensuring HARNCE engineers have safe, unobstructed access to all assets within the agreed service register during the scheduled service window. Where access cannot be gained on the day, HARNCE will make one return visit at no additional charge. Subsequent return visits for the same asset will be charged at the standard hourly rate of £100 per hour, plus any materials required. Time spent on site where access is denied due to circumstances beyond HARNCE's control remains chargeable.
Post-Service Liability
HARNCE's service programme tests and certifies each TMV at the point of service. HARNCE accepts no liability for valve performance between service visits, or for changes in water temperature arising from system changes, third party works or component failure after the service date. Bowbrook should report any temperature anomalies immediately so HARNCE can respond promptly.
CQC Compliance Letter
The annual CQC compliance summary letter (included on 3 year contracts) confirms the scope and outcome of HARNCE's annual service programme only. It does not constitute a guarantee of site-wide water safety compliance and does not cover assets outside the agreed service scope, shower TMVs managed in-house, or the period between annual service visits.
Payment Terms
First service invoiced in full on contract signing, payable within 7 days. The first service visit will be scheduled on receipt of cleared funds. Contract services from service 2 onwards collected by GoCardless Direct Debit in equal monthly instalments commencing the month following the first service visit. If a Direct Debit payment fails, HARNCE will notify the client within 5 working days. If payment is not received within 14 days of notification, HARNCE reserves the right to suspend the service programme until the account is brought up to date. Remedial and recommended works invoiced on completion, payable within 14 days.
Price Review
Monthly contract payments are fixed for the duration of the term. HARNCE reserves the right to apply a maximum CPI-linked increase of 5% at the start of year 3 on 3 year contracts only, with a minimum of 30 days written notice. This is a backstop protection only and will not be applied unless cost increases make it necessary. 2 year contract pricing is fully fixed with no review.
Cancellation
Fixed term contracts may not be cancelled during the fixed term except by mutual written agreement. Early termination may be subject to a fee equivalent to the remaining contract value. Cancelled months do not extend the contract term.
Documentation
Full updated asset register, test certificates and written service report provided within 5 working days of every visit. Gas Safe records provided for all gas appliances. CQC compliance summary letter issued annually on 3 year contracts. All documentation is specific to the agreed service scope and assets listed in the service register.
