Why We Are Here
TMV Compliance — Why It Matters

HARNCE was engaged following a compliance inspection at Bowbrook carried out by Total Environmental Compliance Ltd in December 2024. That inspection identified 8 failures across the installed TMV units. In addition, our own site survey identified a further 6 unprotected mixer tap outlets. This proposal sets out how HARNCE will service all 222 TMV units, address the identified defects and maintain full compliance going forward.

What is a TMV and Why Does It Matter in a Care Home?

A Thermostatic Mixing Valve blends hot and cold water to deliver a safe, controlled outlet temperature — typically 39–43°C — preventing scalding at the point of use. In a care home where residents may have limited mobility, reduced sensation or cognitive impairment, a failed TMV presents a direct and serious risk of scalding injury. Annual testing and servicing is not optional — it is a legal requirement under multiple regulatory frameworks.

Regulatory Framework
The Legal Requirement

TMV servicing in a care home is governed by a layered framework of legislation, approved codes of practice and industry standards. Non-compliance exposes the operator to regulatory sanction, civil liability and CQC enforcement action.

HSE ACOP L8 — Legionella
Approved Code of Practice requiring regular inspection, testing and maintenance of all water fittings including TMVs. Non-compliance is a criminal offence.
HSG274 — Technical Guidance
HSE technical guidance supplementing L8. Part 2 covers hot and cold water systems and mandates annual TMV servicing including fail-safe testing to the TMV2/TMV3 scheme.
TMV3 Scheme — Healthcare
Sets the standard for TMVs in healthcare and care environments. Requires annual servicing, fail-safe testing, temperature verification and full documentation by a competent person.
HTM 04-01 — Safe Water in Healthcare
NHS Health Technical Memorandum covering water safety in care premises. Sets requirements for TMV installation, maintenance and record keeping in care settings.
Health & Safety at Work Act 1974
Places a duty of care on those in control of premises to protect all persons. A scalding incident from a failed or unserviced TMV would likely constitute a breach of this duty.
Care Quality Commission (CQC)
CQC assessments cover fundamental standards of safety. Water safety compliance and TMV servicing records are an active area of CQC scrutiny in care home inspections.

The Bowbrook Position Right Now

A third-party inspection has placed 8 TMV failures on record at Bowbrook. A further 6 mixer tap outlets have been identified during the HARNCE survey that currently have no TMV protection. Until these are resolved and a structured servicing programme is in place, Bowbrook's compliance position remains exposed. HARNCE's programme closes that gap completely.

Part One — Annual Programme
TMV Service — 222 Units

HARNCE offers two service levels for the annual TMV programme across all 222 units — 216 existing TMVs plus 6 newly installed units on the mixer tap outlets identified during our survey. All pricing shown is at standard pay-as-you-go rates. Contract pricing and discounts are shown in the Contract Options section.

Essential Service
Test, record and flag — compliance audit
1.Confirm asset location and verify isolation valves are present and operable
2.Run outlet for 60 seconds and record baseline temperature before any intervention — flag immediately if above 41°C
3.Verify blended temperature reaches 39–43°C within one minute of flushing
4.Perform fail-safe test — isolate cold supply and confirm flow stops completely
5.Apply service label and record baseline temperature, pass/fail result and isolation valve condition against asset register
6.Provide written list of all failed units to site manager on same day
7.Isolate hot and cold supplies fully
8.Remove strainer, descale and clean all components thoroughly
9.Remove cartridge, inspect all internal components, replace O-ring as standard
10.Post-service temperature verification, fail-safe retest and written remedial report

Strip, descale, O-ring, certify — full internal inspection
1.Confirm asset location and verify isolation valves are present and operable
2.Run outlet for 60 seconds and record baseline temperature — flag immediately if above 41°C
3.Isolate hot and cold supplies fully and confirm isolation by briefly opening outlet
4.Remove strainer and cartridge — lay all components on a clean tray, note condition of O-rings and seals
5.Descale and clean all components — soak strainer in descaling solution, clean cartridge housing and inlet ports, rinse thoroughly
6.Replace O-ring as standard — replace strainer or cartridge if scaled beyond cleaning, worn or damaged
7.Reassemble valve in correct orientation — refit strainer, cartridge and end cap, reinstall to pipework
8.Open cold supply first then hot — check all connections for leaks, allow system to stabilise
9.Run outlet for 60 seconds — record post-service temperature, verify within 2°C of baseline and within safe range, adjust or escalate if outside tolerance
10.Perform fail-safe test — if hot water continues to flow rather than stopping, valve must be replaced. Record all readings, parts replaced and remedial recommendations on service sheet

Part Two — Annual Programme
Plant Room Service — All Assets

The plant room service operates to a single comprehensive standard on every annual visit. Gas Safe-regulated boilers and pressurised water heating appliances cannot be maintained to a reduced standard. All pricing is at standard pay-as-you-go rates. Contract pricing is in the Contract Options section. Pricing is subject to confirmation following a full pre-contract plant room survey.

Services 2, 3 and 4 — Spread Over 12 Monthly Payments Each

On a 2 or 3 year fixed contract, the cost of each subsequent annual service is spread equally over the 12 months that follow, collected by GoCardless Direct Debit. 6 Mixer Taps — TMV Installation Recommended
During the HARNCE site survey, 6 mixer tap outlets were identified that currently have no TMV protection. Following discussion with site management, it is recommended that TMV2/TMV3 approved thermostatic mixing valves are installed on each of these outlets to bring them into line with the TMV3 standard and ensure consistent compliance across the site. These 6 units are included in the 222-unit annual service count from year one of the contract. These works are subject to client authorisation and have not been included in the service contract pricing above.

Plant Room Defects — Survey Findings
Item 1 — Plant Room Floor Leak
Significant rust staining visible on the plant room floor around the dirt separator drain and low-level pipework, indicating an active or historic water leak. Requires investigation, repair or component replacement. Left unaddressed this will accelerate corrosion of adjacent plant.
Item 2 — Corroded Expansion Vessel Pipework
The pipework connection at the expansion vessel base shows significant corrosion beyond normal wear. The condition of the fittings represents a potential system integrity risk. Investigation and likely replacement of the affected section is recommended.

Terms & Conditions
What You Need to Know

The following terms apply to all works carried out by HARNCE Heating & Plumbing at Bowbrook Care Home under this proposal and any resulting contract.

Scope of Scheduled Works
The fixed contract price covers the annual scheduled TMV and plant room service only. Any additional works identified during a service visit will be quoted and agreed in writing before proceeding, at the applicable contract discount rate.
TMV Replacement Allowance
Up to 3 or 10 like-for-like TMV replacements per year (depending on contract) are included where a valve cannot be restored during the annual service. Does not cover damage by third parties, system contamination or works by others. Replacements beyond the annual allowance charged at fixed replacement price less applicable contract discount.
Float Stock
HARNCE maintains float stock TMV units for the duration of the contract. Used units replaced within 5 working days. Float stock remains the property of HARNCE until installed.
Payment Terms
First service invoiced on completion, payable within 14 days. Contract services from service 2 onwards collected by GoCardless Direct Debit in equal monthly instalments. Remedial and recommended works invoiced on completion, payable within 14 days.
Subject to Final Survey
Plant room pricing subject to confirmation following a full pre-contract survey. TMV pricing based on the asset register dated December 2024 and subject to verification on first visit. Any material variation agreed in writing before commencement.
Recommended Works
The 6 mixer tap TMV installations are recommended works pending client authorisation. They are not included in the service contract price. Once authorised, they will be carried out at the applicable contract discount rate and the units added to the annual service register.
Access
Bowbrook is responsible for ensuring HARNCE engineers have safe, unobstructed access to all assets. Where access cannot be gained due to circumstances beyond HARNCE's control, time spent on site remains chargeable. Inaccessible assets reported to site manager on the day.
Inflation & Price Review
Fixed term contract prices held for the duration of the fixed term. A maximum CPI-linked increase of 5% may apply at the start of year 3 on 3 year contracts, with 30 days written notice.
Cancellation
Fixed term contracts may not be cancelled during the fixed term except by mutual written agreement. Early termination may be subject to a fee equivalent to the remaining contract value.
Documentation
Full updated asset register, test certificates and written service report provided within 5 working days of every visit. Gas Safe records provided for all gas appliances. CQC compliance summary letter issued annually on 3 year contracts.
